These Prepayment Terms and Conditions ("Agreement") govern all advance payments made to Balcon Salon, a business operated by Advanced Aerospace LLC ("Balcon Salon," "we," "our," or "us"). By submitting payment, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
1. Nature of Prepayment
Your payment reserves products, services, seating, event space, accommodations, or other hospitality services for the date and time selected. Once accepted, Balcon Salon commits personnel, inventory, staffing, and space based upon your reservation.
2. Authorization of Payment
By submitting payment, you certify that:
You are the authorized holder of the payment method used.
You authorize Advanced Aerospace LLC d/b/a Balcon Salon to charge the full amount displayed before checkout.
The amount charged accurately reflects your purchase.
You understand the terms governing cancellations and refunds.
3. Reservation Confirmation
A reservation is not confirmed until:
Payment has been successfully processed;
You receive a confirmation from Balcon Salon; and
We accept the reservation.
We reserve the right to decline or cancel any reservation before confirmation if necessary. If we decline your reservation, any payment received will be refunded.
4. Cancellation by Customer
Unless otherwise stated in writing for a specific event or private booking:
Prepayments are non-refundable.
Cancellations do not entitle the customer to a refund.
Failure to appear ("No Show") results in forfeiture of all prepaid amounts.
If Balcon Salon elects, in its sole discretion, to offer a credit or reschedule a reservation, such accommodation does not create an obligation to do so for future reservations.
5. Private Events
For private parties or events:
Deposits reserve the requested date and time.
Deposits are earned upon receipt because Balcon Salon removes inventory and scheduling availability from public sale.
Unless otherwise agreed in writing, deposits are non-refundable.
Final guest counts and payment deadlines will be provided separately when applicable.
6. Customer Changes
Requests to change dates, guest counts, or reservation details are subject to availability and are not guaranteed. Any approved modification may require additional payment.
7. Cancellation by Balcon Salon
If Balcon Salon cannot provide the reserved services due to circumstances within our control, we may:
reschedule your reservation; or
refund amounts paid for services that cannot be provided.
Our liability is limited to the amount you paid to us.
8. Force Majeure
Balcon Salon shall not be liable for delays, closures, or inability to perform caused by circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, government orders, utility failures, labor disputes, public health emergencies, or other unforeseen events. In such cases, we may offer rescheduling or a credit at our discretion.
9. Chargebacks and Payment Disputes
If you believe a billing error has occurred, you agree to contact Balcon Salon before initiating a dispute with your payment provider so we may attempt to resolve the matter promptly.
You acknowledge that:
your payment constitutes authorization for the transaction;
these Terms describe our cancellation and refund policy;
records of your reservation, payment authorization, communications, and acceptance of these Terms may be used to respond to payment disputes.
Nothing in this Agreement limits any rights you may have under applicable law or the rules of your payment card issuer.
10. Refund Policy
Except where required by law or expressly stated in writing by Balcon Salon:
all prepayments are non-refundable;
unused reservations are forfeited;
dissatisfaction with matters outside Balcon Salon's reasonable control does not entitle the customer to a refund.
Approved refunds, if any, will be issued only to the original payment method.
11. Alcohol Service
Balcon Salon reserves the right to refuse service to any person as permitted by applicable law, including service to intoxicated individuals, underage persons, or anyone presenting false identification. Such refusal does not automatically entitle the customer to a refund where the refusal results from the customer's conduct or legal ineligibility to receive alcohol service.
12. Limitation of Liability
To the fullest extent permitted by law, Advanced Aerospace LLC d/b/a Balcon Salon shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your reservation or purchase. Our total liability shall not exceed the amount actually paid for the applicable reservation or services.
13. Governing Law
This Agreement shall be governed by the laws of the State of New York, without regard to its conflict of law principles. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located in New York, unless otherwise required by applicable law.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms constitute the complete agreement between you and Balcon Salon concerning your prepayment and supersede prior discussions relating to the reservation or purchase.
16. Acceptance
By selecting the checkbox agreeing to these Terms and Conditions and submitting payment, or by otherwise completing your purchase, you acknowledge that:
you have read these Terms and Conditions;
you understand them;
you agree to be legally bound by them; and
you understand that your payment is subject to the cancellation and refund policy described above.
